These Terms and Conditions (“Terms”) govern your access to and use of the website www.hikecampseek.com.au and all related services (collectively, “Website” and “Services”) provided by Hike Camp Seek, a registered partnership in Australia (“we”, “us”, “our”). By accessing or using the Website and Services, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Website or the Services.

1. Acceptance of Terms

By using or accessing the Website in any way, you agree to:

  • Be bound by these Terms
  • Comply with all applicable laws and regulations
  • Accept responsibility for all activity under your account

We may update these Terms from time to time. When we make material changes, we will notify registered users by email or by posting a prominent notice on the Website, and we will update the “Last updated” date at the top of this page. Changes take effect when posted unless otherwise stated. Your continued use of the Website after changes are posted constitutes your acceptance of the revised Terms.


2. Description of Services

Hike Camp Seek provides an online platform designed to help users:

  • Search for campgrounds and accommodation listings and related information
  • Set alerts for cancellations at previously sold-out sites (account required)
  • Use trip planner tools to organise trips, itineraries, and travel planning features
  • Access booking functionality via a third-party booking engine hosted and operated by Bookeasy Pty Ltd (ABN 68 122 744 209)

You must create a user account to set alerts and use certain features of the Services. Alert functionality is currently provided free of charge to all registered users.

Booking Integration (Bookeasy)

Bookings are processed through the Bookeasy booking engine, accessible at book.bookeasy.com/agent/hike-camp-seek. The booking engine is a third-party service hosted and operated entirely by Bookeasy Pty Ltd. When you make a booking:

  • You are transacting directly with the accommodation or service provider via the Bookeasy platform
  • All booking availability, pricing, fees, payment processing, cancellation policies, and refund policies are governed by Bookeasy’s Terms and Conditions and the individual accommodation provider
  • Hike Camp Seek does not process payments, hold funds, set pricing, or control booking outcomes
  • You may be required to agree to additional terms from Bookeasy and/or the accommodation provider during the booking process

We do not guarantee availability, suitability, or confirmation of any booking. For booking-related enquiries, cancellations, or refunds, please contact Bookeasy directly at support@bookeasy.com.au or the relevant accommodation provider.

Changes to the Services

We reserve the right to modify, update, suspend, or discontinue any part of the Services (including features, functionality, or content) at any time. Where a change materially affects your use of the Services, we will endeavour to provide reasonable notice via the Website or email. Continued use of the Services after such changes constitutes your acceptance of the modified Services.


3. Eligibility

To use the Services and create an account, you must be at least 18 years old and capable of entering a binding agreement under applicable law.


4. User Accounts and Registration

(a) Account Required: You must register for a user account to set alerts or use certain Services.

(b) Information must be truthful, accurate, and kept up to date.

(c) You are responsible for:

  • Account security
  • All actions taken under your account

(d) You agree to notify us immediately if you become aware of unauthorised use.

(e) Each person may hold only one account. You must not share your account credentials with others or allow others to access the Services through your account.

We may suspend or terminate accounts at our discretion, including for violation of these Terms.


5. Notifications and Communications

Opt-In Alerts

Hike Camp Seek sends notifications only when you explicitly opt in by creating an alert. Each alert you create constitutes your consent to receive electronic communications regarding availability changes for that specific campsite, accommodation, or service.

Notification Channels

Depending on your account settings, notifications may be delivered via:

  • Email — sent to the email address associated with your account
  • WhatsApp or other messaging services — sent to the phone number you provide in your account settings

You are responsible for ensuring your contact details are accurate and up to date.

Managing and Stopping Notifications

You have full control over the notifications you receive at all times. You may manage all your alerts at any time by visiting the My Alerts page. You can:

  • Pause or delete individual alerts to stop notifications for specific sites
  • Change your preferred notification channel (email or messaging) via your account settings
  • Delete all alerts to cease all notifications
  • Delete your account entirely to remove all stored data and stop all communications

Changes to your notification preferences take effect immediately.

Service Communications

In addition to alert notifications, we may send you essential service communications (such as account verification, password resets, and material changes to these Terms). These communications are necessary for the operation of your account and are not marketing messages.


6. User Conduct and Acceptable Use

When using the Website, you must not:

  • Use the Website for unlawful purposes
  • Interfere with Website security or functionality
  • Attempt to access restricted areas of the Website
  • Submit inappropriate or harmful content
  • Send spam, unsolicited marketing, or abusive communications
  • Use any automated means (including bots, scrapers, or scripts) to access the Website, collect data, or interact with the Services without our prior written consent
  • Reverse-engineer, decompile, or attempt to extract the source code of the Website or any related software

We may remove content or restrict access for violations.


7. Intellectual Property Rights & Copyright

Ownership

All content on the Website, including text, graphics, logos, trademarks, software, and database compilations (“Content”), is owned by or licensed to Hike Camp Seek and is protected by Australian and international intellectual property laws.

Copyright

Copyright in the Content arises automatically under the Copyright Act 1968 (Cth). Your use of the Website does not grant you any ownership of the Content.

Restrictions

User Content

By submitting any feedback, reviews, or other content, you grant us a perpetual, royalty-free, worldwide licence to use, reproduce, and adapt that content.

8. Third-Party Content and Links

The Website may contain links to third-party websites, services, or resources (“Third-Party Content”), including the Bookeasy booking engine, accommodation provider websites, and external mapping or informational services. We do not control, endorse, or assume responsibility for any Third-Party Content, including its accuracy, legality, availability, or policies.

In particular, the Bookeasy booking engine is operated by Bookeasy Pty Ltd and is subject to its own Terms and Conditions (which include their privacy policy provisions). We encourage you to review these before making a booking.

Your interactions with third parties, including any transactions or disputes, are solely between you and the relevant third party.


9. Disclaimers

The Website, Services, and Content are provided “as is” and “as available” without warranties of any kind.

To the fullest extent permitted by law:

  • We make no warranty of accuracy, reliability, completeness, or fitness for a particular purpose
  • We do not guarantee uninterrupted availability
  • We disclaim all implied warranties, including merchantability and fitness for use

Notification Delivery

While we make reasonable efforts to deliver notifications promptly, we do not guarantee that any notification will be delivered, delivered on time, or received by you. Notification delivery depends on third-party services (including email providers and messaging platforms) that are outside our control. Receipt of a cancellation notification does not guarantee that the campsite or accommodation will still be available when you attempt to book.

Information Accuracy

Campground, caravan park, and accommodation information displayed on the Website — including availability, pricing, facilities, conditions, directions, trail conditions, and safety information — is provided for general informational purposes only and may be sourced from third-party providers (including Bookeasy and individual park operators).

We do not guarantee the accuracy, completeness, or currency of any listing information. Such information may change without notice. You should verify details directly with the accommodation provider or park authority before travelling or making any decisions based on information obtained through the Website.

The Website does not constitute professional travel, safety, medical, or financial advice.

Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement. If the Australian Consumer Law applies to you, our liability for breach of a consumer guarantee is limited, to the extent permitted by law, to the resupply of the relevant Services.


10. Limitation of Liability

To the maximum extent permitted by law, Hike Camp Seek and its affiliates are not liable for any:

  • Direct, indirect, incidental, special, or consequential loss
  • Loss of data, revenue, profits, or goodwill
  • Errors, interruptions, or delays in notifications or services

Where liability cannot be excluded (including under the Australian Consumer Law), it is limited to the resupply of the relevant Services.


11. Indemnification

You agree to indemnify, defend, and hold harmless Hike Camp Seek and its officers, partners, employees, and agents from any claims, losses, liabilities, costs, or expenses arising from:

  • Your use of the Website
  • Violation of these Terms
  • Claims related to your content or account

12. Service Costs and Third-Party Bookings

Hike Camp Seek Services

Alert functionality and use of the Website are currently provided free of charge. We reserve the right to introduce paid features or plans in the future, at which point updated terms will be posted on the Website prior to any charges taking effect.

Booking Costs

Any costs incurred when making a booking through the Bookeasy booking engine — including accommodation fees, service fees, and any applicable taxes — are set and collected by the accommodation provider and/or Bookeasy Pty Ltd. Hike Camp Seek does not set, collect, or process any booking payments.

Cancellations and Refunds

Cancellation and refund policies for bookings are determined by the individual accommodation provider and Bookeasy. As stated in Bookeasy’s Terms and Conditions, cancellations of confirmed bookings may attract an administration fee in addition to any cancellation fee set by the accommodation provider.

Hike Camp Seek is not responsible for, and cannot process, refunds or cancellations for bookings made through the Bookeasy platform.


13. Termination

We may suspend or terminate your account or access to the Website at any time, with or without notice, for conduct that we reasonably believe violates these Terms or is harmful to other users.

You may terminate your account at any time by deleting your account through your account settings or by contacting us at contact@hikecampseek.com.au.

Upon termination (whether by you or by us), your account data, including saved alerts and preferences, will be deleted in accordance with our Privacy Policy. Termination does not affect any rights or obligations that accrued prior to the date of termination, and the provisions of these Terms that by their nature should survive (including Sections 7, 9, 10, 11, 14, 15, and 17) will continue in effect.


14. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated by reference and forms part of these Terms.

In order to provide the Services, we collect and store personal information including your name, email address, and (if you opt in to messaging notifications) your phone number. This information is used to operate your account, deliver notifications, and communicate with you about the Services.

When you make a booking through the Bookeasy booking engine, your personal information (including name, contact details, and payment information) is collected and processed by Bookeasy Pty Ltd in accordance with the privacy provisions in their Terms and Conditions. We encourage you to review Bookeasy’s privacy practices before completing a booking.


15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Victoria, Australia, without regard to conflict-of-law principles.

If a dispute arises in connection with these Terms or your use of the Website, the parties agree to first attempt to resolve it in good faith by contacting us at contact@hikecampseek.com.au. If the dispute cannot be resolved informally within thirty (30) days, either party may submit the dispute to the exclusive jurisdiction of the courts of Victoria, Australia.

Nothing in this section limits your right to lodge a complaint with the Australian Competition and Consumer Commission (ACCC) or any applicable state or territory consumer protection agency.

17. Miscellaneous

(a) Severability: If any provision is invalid or unenforceable, it will be severed without affecting the rest of these Terms.

(b) Entire Agreement: These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Hike Camp Seek regarding your use of the Website and Services.

(c) No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

(d) Headings: Headings are included for convenience and do not affect interpretation.

(e) Force Majeure: We are not liable for any failure or delay in performing our obligations (including the delivery of notifications) where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, power outages, internet or telecommunications failures, government actions, pandemics, or failures of third-party service providers.

(f) Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to a third party (for example, in connection with a merger, acquisition, or sale of assets) without your consent, provided that your rights under these Terms are not diminished.
